Since 2015 it has been a legal requirement that all landlords of residential rental properties have a Legionella Risk Assessment completed and act upon its recommendations.
This assessment must then be reviewed periodically depending on the level of risk. The law does not require landlords to hold a ‘Legionnaires testing certificate', nor is Legionella (laboratory) testing usually required. The Health and Safety Executive has stated that there is no reason why a landlord cannot carry out this risk assessment themselves, so long as they are competent. They should retain reasonable proof that the risk assessment was conducted and that they acted upon its recommendations. The person conducting the assessment should understand the water system and any associated equipment in order to conclude whether the system is likely to create a risk from exposure to legionella.
