The Renters’ Rights Act: Our Experience So Far

Since the Renters’ Rights Act came into force, we have encountered several practical misunderstandings among landlords and tenants alike.

The end of fixed-term tenancies has caused the most confusion. Some tenants have contacted us, concerned about why we have not approached them about renewing their tenancies. On one occasion, a tenant arrived at our office without prior notice to return the keys on what would previously have been the final day of their fixed term. Fortunately, the landlord was understanding, and we were able to re-let the property promptly.

Another common issue has involved tenants arriving from overseas who offer to pay twelve months’ rent in advance, unaware of the new restrictions. In several cases, professional guarantor companies have provided a practical alternative.

We have also seen both landlords and tenants rely on clauses in older assured shorthold tenancy agreements without realising that the new legislation overrides any conflicting terms.

We have not encountered tenants who believe they now have an automatic right to keep a pet, although we understand that some other agents in the town have.


Our view

There are many changes to absorb, even for experienced agents. Where misunderstandings arise, we would encourage landlords and tenants to be patient, reasonable and forgiving while everyone adjusts.
